Wherever justice is practically sold for money
no matter how high the pretensions of any state to refinement
and liberty may be — that state is truly in a state
of Barbarism and slavery; and the tyranny and cruelty
of a Turkish Bashaw, or a West India slave owner, are
money and generosity, compared to the prolonged tortures
of a tedious and expensive law suit; or to the agony
inflicted upon a poor man by the absolute denial of
justice which is implied in an edict, that it is only
to be procured at a cost which exceeds all his pecuniary
resources an hundred fold. While such things
exist, it is all vain boasting to talk of our laws and
liberties. We read of them indeed in Blackstone and
De Lolme — and they exist in theory in the Declaration
of Rights at the Revolution — but how many are
then in this land of freedom who are as absolute slaves
as exist on the face of the earth, because they do not
possess adequate means of legal defence against injury
and because practically they are driven from the very
threshold of a Court of Law by its delay and its expense?
But let us come to particulars. Our attention at this
time shall be directed to the taxes which are directly
levied on litigants in the Court of Session. Of these, the
most palpable and glaring are the exactions made for
the supply of what is called the Fee-fund. This fund was
called into existence by an act of Parliament (50. G. III.
Cap. 112) which put an end to the monstrous system
of extracting decrees in the Court of Session that
had previously obtained; and because certain clerks and
