and their clerks were deprived of the emoluments
they formerly enjoyed, a tax upon all future litigants
was imposed for their benefit. Since that time, another
act of Parliament, and sundry acts of Sederunt,
have extended the objects of this fund; and it has now
arrived at such a magnificent maturity, that if the
per centage allowed to the collection for receiving this
tax shall in any year fall short of £600, the said
collection shall in such year be entitled to retain
the full sum of £600, as the allowance for his trouble!

When £600 per annum is paid to a collector
for sitting in a room at the Register-house during a
few hours every week to receive this revenue, the amount
of it can not be very trifling; but its operation
will be best judged of by attending to the fact, that before
an cause can be heard for the first time, by the
Lord ordinary in the Outer House, upon a closed record,
made up according to the new system in the shortest
possible way, on a revised condescendence and answers,
the payments to the fee fund amount to £4. 1s 1d;
and when to this sum are added the fees of enrolment
(which go to the same fund) and dues of clerk's assistants
for lodging and borrowing the papers, the outlay amounts
to £8. 0s 8d , or £4. 0s 4d to each party. This, be it observed,
is the very lowest sum of the tax upon every
case, where the record is made up in the ordinary way.
If the correction of papers is continued through a third
and fourth re-revisal, the expense accumulates space
with enrolment for prorogations, &: and all this is
exclusive entirely of all the payments to counsel
and agents for this professional labours, and before
parties are in a condition to say one word to the
Judge on the merits of the cause.
