in many parts of the country justice could not be
administered at all without practitioners, whose emoluments
render it utterly impossible that they can
afford to pay such an exorbitant taxation. In the
remotest county counts, the tax is £8 per annum.
There are, we have reason to believe, several hundred
prosecutions going on at present against Scots practitioners,
who have omitted to take out their licence;
and such an omission, besides, is found to be a bar
to their recovering, by legal process, any account due to
them for outlays, or professional exertions.

If as we have sometimes heard, this import
was invented on purpose to exclude low and
improper persons from acting as agents, the device is
nugatory; and it is a great mistake to suppose that
an aristocracy in this Department can even be created
by imposing heavy pecuniary penalties burdens at the entrance of
individuals on their professional walk, or after they enter
it. For, we will venture to affirm, that there are many
of the best Law agents in the Supreme as well
as in the Inferior Courts, who started in their career
very slenderly endowed, either with patronage or patrimony,
and who got solely by their integrity,
assiduity and professional skill, so as completely to outstrip
others of higher pretensions to fortune and to
assumed respectability, as men of business. The tax,
as it exists, is a position tax upon justice, because
it must ultimately be imposed upon the employer;
it is an impediment to the free and easy attainment
of it by circumscribing, in some degree, the
operations of the profession generally. But of all the
absurdities which belong to this class of assessments the
