The commercial resident, in dealing on
account of his own private trade, shall not make
the Company's prices the standard of his own.
C. 4. §. 15.

While the East India Company enjoys
the privileges of the law above recited, it is impossible
to deny that it possesses a monopoly in
every article of the internal trade of its provinces
which it may select for its investment.
Raw silk, saltpetre, and cotton, are at present the
principal articles which the company buy for
its trade in the criterion, through the agency of its
Commercial Residents.

Muslims, piece goods may however again
become the object of its speculation, and
a local administration, less liberal than the
present day may call into action the dormant
privilege of the Company to secure a monopoly
in Indigo, or any other produce. It will hardly
be contended that it is right that a trading body
should thus possess the power of crushing the
industrious enterprise, and ruining the fortunes,
of the mercantile community of an extensive
empire.

That this would be the result of an
active and general exertion on the part of the
company of the privileges which it has bestowed
on itself, can only be devoted by those to whom
the effects produced at particular places by the
trading operation of the Company, are not familiar.

the Contract with the Company, might be subsequent
to the adverse contract with the private merchant.
The justness of this principle seems to have secured
to the power of the law; he however has carefully abstained
from its explicit recognition. Sect. 8. of Regulation
9 of 1801 distinctly provides that any unperformed
contract on account of the Company's investment, shall
afford an exemption from personal restraint.
