Another great & unjust evil both in the judicial
& legislational departments is the want of publicity.
Publicity is the only security for justice. Bentham
in a passage as attractive for the beauty of its , as
admirable for the fact of its reasonings (Judicial
Establishment) calls publicity the soul of justice. Thro' it
alone justice becomes the mother of security. A German
moralist has said Man is good – men are evil – & why? because
he was accustomed to contemplate men in unclave – men met
together in secret without responsibility & without dread of
exposure. Even where their proceedings are public, bodies of men
are accustomed to do witlessly what in their individual capacity they
would blush – or refuse – or disdain to do. What chances are
there then for justice when it is proposed to be violated by the concurrent act of members – when the stigma of reproach is divided
among many & each fancies his own portion to see all as
not to be worth his care or concern, & where above most fatal are of all, every
individual is screened from animadversation & from
observation – where the work is one of darkness & of
concealment?
