Art. 3. And whereas the Proposal of the said Jeremy
Bentham which formed the present basis of the present
agreement, and in which the said sum of £27000 was
required on the part of the said Proposer for the
purposes aforesaid, was delivered in or on or about
the 17th of March which in the year of our
Lord 1793 And whereas since that time the
prices of divers articles necessary as materials for the
said intended Building may have as well as of divers articles
necessary for the support of the maintenance of the said number of one thousand Convicts
establishment, the expence of which maintenance for the first year and the building would have be built before the maintenance cost plain
was included in the said estimate of £27000 may
have either by taxes or other circumstances by the circumstances of the times be found to have undergone
a very considerable enhancement, in consequence
whereof the effective power of the said proposed
sum of £27000 though nominally the same would partial allowance of £27000 as of the said Proposers private stock would
destined to the said purposes have been added is would though nominally the same, become
in effect be less and so much the less and proportionably insufficient for the said intended purposes
And whereas in particular the price of bricks
hath within the said period undergone an enhancement
by means of a duty thereon imposed by Parliament, to
wit by an Act of the 28th March 1794, ch. 15 as also the price
of glass by an Act of the 1794. ch. 37. And
whereas the delay from whence such increase of charge may hath
