N. S. Wales
This is but skirmishing What is above is matter rather of illustration, than
of necessary argument. For But how indisputable soever
were the right of the Crown to grant legislative powers
to persons planting Colonies on the footing any modification of on which
the American Colonies were planted, this non- descript
Colony sui generis this non-descript and unexempted
Colony of New South Wales would be never not
the better for it. [+] [+] There are two circumstances Admitting the power Crown to possess a power right of creating mak increasing legislation power was constitutions for Colonies or conferring powers for the creation of such issues To 1 — In all All those precedents this
have this circumstance in common, that the persons over
whom the powers you created by the Crown, mediately
or immediately, were persons who by their own previous
consent, not general and constructive, and general but actual and
individual, had subjected themselves and their posterity to the exercise of
those powers; whereas here the very res reason consideration by
which this assumption of power on the part of the Crown
was in the mind of the advisers of the Crown produced
was, that the consent of the persons principally interested was
altogether hopeless. The principal and only avowed
object (avowed I mean in conversation for in Parliament
for any thing that appears silence was the order of the day)
The principal and only manifested object — indeed the only
object besides the play-thing was the making provision in the instance
of by far the greater almost the whole part of the population of the Colony
for subjecting this unhappily but too extensive description
of his Majesty, subjects to a mass of illegal punishment,
over and above and much superior to the mass
of legal punishment to which they had been
subjected by their respective , and thereby by the sole authority of the Crown, under
colour of an authority surreptitiously obtained from Parliament
to introduce supply in effect a bit of sponsors
vitiate prof pervert and vitiate the provision
