The only other mode of accounting for the illegal
conduct is to suppose that the prime movers of
the business were conscious of the non-existence illegality
of the right, but defended conscious of the illegality
of their conduct, but depended upon it's being taken for
legal and as such submitted to by the several parties
interested.
