Thus far in the case according to the prescription in the Act where the transportation is
performed by a private Shipmaster. But have there
not been instances where it has been performed by
without any such intervention, in vessels
respectively under the command of an Officer in his
Majesty's service? In such case where is the
authority for what is done? There is none in any
Act. In such case, either it must be done without
law, and therefore in a manner contrary to law, or a
sham Contract must be entered into, to bring the case
within the purview of the law.
