by which transportation for limited terms is appointed: that this
persevering and systematic violation of one of the sacred articles
of the constitution has all along been committed under the eye
and the instructions of Mr Pitt and his colleagues, by whom
the colony was founded for that very purpose, according to their
manner of founding colonies: that it is not now, as perhaps at
first, in an indirect way only and by a trick (the substituting
the physical obstacle of local distance to the legal obstacles of
prohibition and punishment) that the object of the institution
(the ridding the community of these its obnoxious members) is
pursued - but the mask, of ever it were put on, has for these
eight or ten years been thrown off; and a system of directly illegal
legislation been kept on foot, by positive orders, or instructions,
informed in the teeth of so many particular Acts of Parliament,
as well as of those general and all embracing laws by which
the most immediately and practically important features of
British liberty are cherished and secured.

One thing appears - as plain as any thing need appear
- upon the face of this most ingenuous and upright
testimony. So far as assurances and engagements are in question,
as hereticks were once said to be to the Church of Rome, so have
convicts been, including those who had ceased to be so, by a governor
of New South Wales.Faith was most necessary to be kept
with them: nor was it kept,(your Lordship sees) unless by accident,
when gentlemen were in a mood for keeping it.

In themselves, the gentlemen in question were, by
every account, honourable men; and in any situation but this,
no exception would probably have ever been taken to the word.
Two misfortunes had befallen them: they had been placed as no human
