Preface
was so ready upon every occasion to boil over and take
fire seems extinct and gone: the part has
corrupted and been dissolved in Toryism: the small remainder
has turned sower and gives zest impulse to the projects
of Republicans and Levellers.
But though the connection between inexpediency
and illegality is not a necessary one, neither is it
one immaterial much less an impassable improbable one. I
speak upon a general view: and in the particular
case instance in question an example I am inclined to think
would be found, The illegality of the measure had
its impotency for the its cause the impotency of the measure.
Powers necessary to government were not
obtained from Parliament—why? because it was not
thought prudent to trust Parliament with the whole
of the information without which the requisite stock
of powers could not regularly—could not according to conveniently
with established forms and current notions be obtained.
The evil disease of illegality be it ever so extensive raging—be it ever so
may be cured by a single touch of the sceptre—may
be cured at any time at once by Parliament. Unquestionably:
but of the above surmise suspicion be true—or even
though it were otherwise—the it is for the reader—it
is for Parliament to judge—whether without some retrospect
Parliament ought to apply the cure; the cure ought to be applied whether
the an indemnity from punishment might to be granted without some
passed upon notice taken of the delinquency—the long and diversified
course of delinquency by which under that dispensation of existing law that punishment
has been incurred.
