Even without calling in the consideration of the object as
declared in the preamble, the efficient interpretation is not which given effect conformable to that object
less apposite than the the narrow and frustrative one interpretation which would be repugnant <add>frustrate to it
By imprisoned may be expressed as well the condition
of the party after the momentary act by which he is first not
that condition is at and, as his condition during the
continuance of that such momentary act. the word so
to the participle imprisoned, add the adverb so, so imprisoned
may accordingly as well mean being already in prison
a state of imprisonment in any of the Gaols, Garrisons,
Islands or Places beyond the Seas, as being in the momentary
condition of one or when the act of sending
him to such a Place is in a state performing taking its course. In this
sense the word imprisoned is synonymous to being
in prison: and immediately afterwards, the words every such
imprisonment are accordingly synonymous to every such
being in prison. The letter Of the two locations, the
latter, though note by no means without example in the
language, especially in the language of the law, is however
not the so natural — not so familiar as the
other — which, accordingly is performed to need employed
in preference to it. According to this interpretation, the
detention of a man will come within the purview of the
Statute, as will in the case when [+] he is in person in
consequence of his having been sent thither abroad in a
state of imprisonment, as in the case when he is [though not be
in a state of imprisonment at the commencement of the operation
by
[+] at the commencement
of such detention
