state of liberty he was after his arrival there sent into
a state of libert imprisonment and so detained.

In circumstances remarkable in this point of
view. In the description given of the prohibited obnoxious act no such
the act of imprisonment — no limitation
such as false what is expressed by the word or illegal the word illegal is employed.

The act When the scene of the act as on any such
foreign ground the act whatever it be the act already
one man is putting another into this painful state
the act whereby such others is already reduced to
that state is yet included in the prohibition
absolutely and generally and in all cases without or restriction exception.
Not that all exceptions are unnecessary: not that no exception
is any where annexed. Exceptions are necessary
but it is by separate and subsequent claims
that they are annexed.

The case ought to be different If the restriction, whether in the form of a
line taken or in the form of an exception, were annexed
instanter — were in with the proportion thus to be
restricted — were it said for example that no subject shall be
illegally sent prisoners into places beyond the seas; and therefore afterwards is
"and that if any of the said subjects shall be so imprisoned
every such person ... so imprisoned may for every such imprisonment
maintain ... and action ... of false imprisonment
against the person or persons by whom he shall be so
committed, detained and imprisoned, sent Prisoner or
transported &c. But there is no such word then as illegally
nor
