Article 2. The said £12,000 shall be deducted
out of the sums to be received by the said
Jeremy Bentham by the for the erection of the
said intended permanent Penitentiary House:
but on the other hand, the said sum of £12,000
shall also be deduced from the sum in respec
to be excepted out of the compensation to be fixed
in respect whereof no compensation is to be
made to the Representatives of the said Jeremy
Bentham upon the decease of the survivor of
him and his Brother Samuel Bentham.
Article 3. If the survivor of the said Jeremy
Bentham and his brother Samuel Benthem
shall die before any prisoners the said
intended permanent Penitentiary House shall have
been opened for the reception of Prisoners, the
said sum of £12,000 shall be deducted from
the sum for which to be allowed to the Representatives
of the said Jeremy Bentham in the
want of this not being continued in the management
of the said intended Penitentiary House:
but if the said Jeremy and Samuel Bentham
or either of them are then alive intended Penitentiary
House shall have been opened for the reception
of Prisoners as aforesaid in the lifetime of the
said Jeremy Bentham or the said Samuel Bentham
of either of them then the said sum of
£12,000 shall not be deducted from the sum to be allowed
to the Representatives of such Survivor as aforesaid.
