"under the power of the said Act, from time to time
"appropriat." — under this clause therefore, his Majesty
before the Permanent Penitentiary House is erected,
may "appoint" me to be Governor thereof when it shall be erected
— before it is erected, he may cause Convicts to be
"delivered into" my "custody" under "such powers and
"directions"... "as, under the powers of the said Act, it
may please him to appoint: and consequently "under
"such direction" as are expressed by the several clauses
contained in the above Draught, as already settled
in the Laws Office. The proposed object of that
Act was to to enable Government to take advantage of any convenient place
or places of confinement, existing or which might
thereafter come to exist, placing prisoners some in one such
place, some in another, or are transferring the
same prisoners from place to place, just as conveniences
might be found: and in the number of those
convenient places will be the proposed Temporary
Penitentiary House, so soon as it shall have been
brought into existence. By the forms of the Act (S.6) His Majesty
may... "direct the removal of any male... offenders
"...under sentence of death, but reprieved for
"during... pleasure, or under sentence or order
"of transportation... to such place of confinement...
"either at land or &c as his Majesty...shall
"from time to time appoint, under the management
"of any Overseer or Overseers to be appointed by his
"Majesty..., and every Offender... so removed shall continue
