Hodges Contract
Now therefore it is hereby agreed the said parties
have promised and agreed and do by these presents
promise and agree, to wit the said Jeremy Bentham
for himself and his said Successors Feof and
the said Benjamin Hodges for himself and his
Exors Admrs Executors Administrators and Assigns, that if the said
Jeremy Bentham &c shall on the said 25th of this instant
pay or tender or cause to be paid or tendered to the said Benjamin
Hodges &c the said sum of £3750, that thereupon
he the said Benjamin Hodges &c shall immediately
and wholly quit possession of the said premises
as well Leasehold as at Will and of every part thereof
and that the said sum of £3750 shall be
but accepted and understood to be in full satisfaction
as well for all damage accruing to him the said
Benjamin Hodges &c his and their Undertenants,
by reason of such quitting of possession as for the
surrender of all such his and their right and
interest to in all and singular the premises as
aforesaid,⊞ ⊞ and that immediately upon the receipt or tendering of the said sum he and they shall and will peaceably and absolutely depart and quit possession of the said premises as aforesaid: And the said Jeremy Bentham for himself and his said Successors doth hereby promise to pay and undertake to pay to the said Benjamin Hodges &c on the said 25th of March next ensuing the said sum of £3750 accordingly.
Provided always and it is hereby nevertheless
further And moreover promised and agreed, that of the said Jeremy Bentham
&c shall permit an the said Benjamin
Hodges &c to continue in possession of the said
premises untill the said 29th of September next
ensuing and on that day and not before should will
pay or tender or cause to be paid or tendered to the
said Benjamin Hodges &c the said sum of
£2000 that thereupon the said Benjamin Hodges
&c shall and will accept the said sum of £2000
in lieu of the said sum of £3750 in full satisfaction
for such damage and surrender as aforesaid.
