And Whereas the said Jeremy Bentham, under the powers of the said
Act, and by direction of the said Commissioners of the Treasury, hath given Notice
to the said John Donne to quit possession on the 25th of this instant March
of all such Tenements, Parcels of the said Estate, as he holds either on Lease
or at Will
, and thereupon to surrender to him the said Jeremy Bentham
all his right and interest to and in the premises —

And whereas the said John Donne hath claimed and made demand
of the sum of £500 The sums herein inserted in Pencil being put merely for example, no regard whatever is to be paid to their amount.
But The amounts as proposed by Mr Donne to proper sums, when settled and agreed upon, may then be inserted in Ink.
as the value of such his right and interest, upon the in respect
of such part of the premises composed in the said Lease as he holds
in his own occupation or on the
supposition of his being obliged to quit possession as aforesaid on the day aforesaid,

of the said Nursery Ground,
inasmuch as such quitting possession of the said premises same on the 25th instant March,
instead of the 25th of March 1801, would will be attended with damage to him the
said John Donne and his under Tenants to the said amount of £500, according
to the Estimate contained in the Schedule marked A and hereunto annexed.

And whereas the said John Donne hath moreover claimed and made demand of the further sum of £183.19s. as the value of his right and interest in
respect of such parts of the premises composed in the
lease as are not in his own occupation, but in the occupation
of divers persons holding under him as Tenants at Will, at the several
rents specified in the Schedule marked B and hereunto
annexed,
and to the said several Tenants comprized in the said Schedule B,
inasmuch as such quitting possession,
as aforesaid, will be attended with damage to him the
said John Donne to the amount of the said sum of
£183.19s the same being the aggregate amount of
the said Rents for the year ending on the said 25th of
March 1801.

And whereas the said estimated Sums of £500 is not greater than and £183.19s
making together the sum of £683.19s
the sum which the said Jeremy Bentham in the exercise of the discretion in
that behalf reposed in him by the said Commissioners of the Treasury, under the
powers of the said Act, thinks fit to be allowed, in satisfaction of the said damage
and as and for the consideration Money to be paid to the said John Donne
for the surrender of all his right and interest in the premises, on the supposition
that such quitting of possession and such surrender are to take place on
the 25th instant —

Now therefore the said parties have promised and agreed and do by
these presents promise and agree (to wit the said Jeremy Bentham for himself
and his said Successors, and the said John Donne for himself his Executors
Administrators and Assigns) that if the said Jeremy Bentham &c shall on the
said 25th of this instant pay or tender, or cause to be paid or tendered, to the
said John Donne &c the Sum of £683.19s that thereupon he the said John
Donne &c shall and will immediately and wholly quit possession of the
said premises and of every part thereof, and that the said sum of £

shall and will be accepted and understood to be in full satisfaction as well as well
for all damage to him the said John Donne &c his and their Undertenants
by reason of such quitting of possession, as for the surrender of all such his
and their right and interest, to and in all and singular the premises as aforesaid,
and that, immediately upon the receipt or tendering of the said sum he and or they
shall and will quietly and absolutely depart from and quit possession of the said
premises as aforesaid: And that he nor they will not at an time demand
or receive of the Occupiers mentioned in the said Schedule B or any of
them the Rents therein mentioned or any part thereof.

Successors, doth hereby promise and undertake to pay to the said John Donne
&c on the said 25th of March next ensuing the said Sum of £683.19s accordingly.
