Being by virtue of the said Lease bound to pay to Mr Foley
the said sum of £40 per Year in respect of which obligation
I shall continue bound notwithstanding my giving up
my Lease to Government the loss to the amount of the said
£150 will on that footing be sustained by me; consequently
that is the sum I shall on that footing claim to receive of
Government, indemnify one for that loss. But if Government
takes upon itself to pay to Mr Foley the said sum of £40
a Year as it becomes due, in that case my claim to the said
£150 will not take place. Mr Foley (I understand) paid
to the Marquis of Salisbury and will now have to pay to
Government, something more than the above £40 viz: under
a Lease comprizing along with my premises held under
him by Lease from time to time as above other premises, which,
in quality of Executor to Mr John Fortey Trustee for his
Widow Mrs Mary Fortey I hold under a separate Lease
granted to me by the said Mr Foley at the rent of £51 per
year clear of Taxes: in relation to which last mentioned
Lease a separate statement will be made in the estimate
of damage sustained by the said Mrs Fortey. —
This matter being to be adjusted in some way or other between
the four parties concerned viz Government Mr Foley Mrs M
Fortey and myself I am ready to concurr in any such measures
as shall be requisite for that purpose.
