that such quitting of possession and such surrender are to take place on
the 25th instant. —

And whereas the said Benjamin Hodges hath represented to him the
said Jeremy Bentham, that if the said Benjamin Hodges were to be permitted
to continue in the possession of the said premises, until the said 20th of September
25th of December
next, to wit as well of this Leasehold parcels of the said premises as of the parcels
holden at Will the amount of the damage by reason of the quitting of the same
would instead of the said sum of £4570 be reduced to the sum of £3000.

Now therefore the said parties and agreed, and do by
these presents promise and agree (to wit the said Jeremy Bentham for himself
and his said successors and the said Benjamin Hodges for himself his Executors
Administrators and Assigns) that if the said Jeremy Bentham he shall on the
said 25th of this instant pay or tender or cause to be paid or tendered to the said
Benjamin Hodges &c the sum of £4750 that there upon the said Benjamin
Hodges &c shall and will immediately and wholly quit possession of the said premises
as well Leasehold as it will, and of every part thereof; and that the said sum
of £4750 shall and will be accepted and understood to be in full satisfaction as well
for all damage to him the said Benjamin Hodges &c his and their
by reason of such quitting of possession, as for the surrender of all such his and
their right and interest, to in all and singular the premises as aforesaid: and
that immediately upon the receipt or tenderings of the said sum, he and they shall
and will, quietly and absolutely, depart from and quit possession of the said premises
as aforesaid: and the said Jeremy Bentham for himself and his said successors doth hereby
promise and undertake to pay the said Benjamin Hodges &c on the said 25th of March next ensuring the said sum of £... accordingly —

Provided always, and it is hereby nevertheless further promised and agreed,
that if the said Jeremy Bentham he shall permit the said Benjamin Hodges &
to continue in possession of the said premises until the said 29th of September 25th of December
next ensuing, and on that day shall pay or tender, or cause to be paid or
tendered, to the said Benjamin Hodges & the said sum of £3000 that thereupon the
