Reasons
But there exists no man who has it not in his power
to obtain the privilege in question without subjecting
himself to any such suffering or any suffering that
can be thought in any degree to approach to it.
By the word of the Statute 22 G.2. c.44. §. 1. "All such Officers, Mariners
"and Soldiers, who have been at any time employed
"in his Majesty's service since his accession to the
"throne and have not since deserted the said service
"may set up and exercise (says the Act) such trades as
"they are apt and able in any town and or place
"within the Kingdom of Great Britain and Ireland, without
"any Lett, Suit or Molestation of any person or persons
"whatsoever for or by reason of the using of such trade:
"whereupon comes the non obstante applying to any Statute
"Law, Ordinance, Custom or Provision to the contrary."
In the Statute of his present Majesty 24 G.3.c.8. §. 1.
this clause is repeated with the addition of the clause
to prevent removal under the Poor Laws.
In the subsequent Mutiny Acts this these two clauses have
it is supposed been inserted.
To be consistent at least, they ought either annually
to be reenacted, or to be enacted for all by a
time clearly prospective. The object is not merely
gratuitous remuneration—but encouragement, designed
to serve as in the character of inducement for engaging persons to enter bend
into themselves to one or other of those several branches of the public
service.
