As to the servants – and the security afforded by the circumstance
of the articles passing under their eyes the eyes of persons of that description – this is the
security whi the view of which compelled me to acknowledge
the supposed security in the character of a real one.
But this is what I must beg leave to lay out of the question:
viz. in the first place because it is a security that has
place as well without as under the any such prohibition as that
in question; in the next place because, forasmuch as
under the contract in question the number of such servants
would uncomfortably be much greater than in the most expensive
House of Correction establishment that could have been
in view under the name of a House of Correction this
part of the security is not that part for which
under that same contract plan any such thing as a
substitute could be to such.

Laying fo then for these reasons the eyes of servants
out of the case, the security for which a substitute was
required, I consider as being that of which the
eye of the Governor is trusted to as the instrument.

In the case in question the character and the only character in which the servants
of the House are capable of furnishing a security is that
of witnesses, eventual witnesses in case of transgression.

The character in which the Governor is placed by
the provision in question seems to be that of Judge. Judge
in the of the propriety of the articles in question; and in that respect thence
Judge over the several persons to whom it may happen to present
themselves for his
approbation in the
character of directions
for the furnishing of
more articles.
