But suppose it were as effectual as it has been seen to be ineffectual
against injury to the prisoners where in so far as such
injury has for its cause, still against injury
in the case where it has ill will for its cause ill will general
cruelty towards all in general, or ill will towards this in that one
in particular, the principle here in question, the sort of division
of power in question is without application applicability and consequently
without efficacy. The power of suppl furnishing supplies
to the prisoners, is, in virtue pursuance of the principles in question, subjected
to division: to division between the Governor and another person
with in the character of dealer.
But to any power besides this the division does not
extend. To protect th For affording to the prisoners protection against
injury arising from having the motive for its source ill will, some other principle
must be looked out for.
Now the principle thus sought requiring to be in demand is if the value of the
principle be any thing like what it is here stated as already
found viz – in the principle of publicity – to which principle
of management it is the object, and if I mistake not, the
necessary effect of the principle viz. principle of construction, to
give its maximum utmost of force.
