Your Memorialist can not forbear looking upon
the decision of the 12 Judges in this behalf as the
more conclusive, and the idea of over-ruling it
by any extra-judicial authority as the more unconstitutional
and indefensible, inasmuch as that venerable
body was may not only were Judges ad hoc, appointed
by the particular Act of Parliament in question,
but, by the general law of Parliament, are in office the
regular and appointed official guardians of all private
rights, in as far as they such rights stand liable to be affected
by Acts of Parliament. In the present instance
the authority of this venerable body was even farther
reinforced by the addition of three other great
Magistrates of no less dignity than that of the Lord
Mayor of London, the Speaker of the House of
Commons, and the Lord High Chancellor: but, not to tire
your Lordships with repetitions, your Memorialist
will beg leave henceforward to waive the mention and the benefit in future of
this additional body of authority, and content himself
with what, to his humble apprehension, is quite
sufficient for the purpose of his argument, the authority
of the 12 Judges.
