The enquiry, as your Lordships see, would hardly not
promise to be does not would at any rate hardly be a short one: but a long one would, if
not manifestly necessary, be clearly indefensible. The very
act of instituting it would be a breach of an offence against the words
as well as the spirit of the law: for by the words of
the Act at the very opening of it your Lordships are
not only empowered but "required" to do one of two
things and that "soon": "as soon after the passing
thereof as conveniently may be": "to fix" either "upon
the said piece or pieces of ground", or else "upon" some
other as convenient and proper spot.
Your Lordships will be pleased to observe: it
is not your Memorialist any body else who is bound to find this other
convenient and proper spot which if not convenient to
your Memorialist in proportion or not convenient
it it is not your Memorialist, it is your Lordships therefore who are to find it, it is
your Lordships who are to have found it already if there
be one. Your Lordships des If the place of it does not lie already upon
your Lordships table, your Lordships in waiting for
it would go against run counter to the requisition of the Act. For the
act which describes the present spot, and gives your Lordships the option of it, is already upon your Lordships
table: and having that knowing of that spot which the Act has pronounced
convenient, and having knowing of no other, if your Lordships
do not take that, you do not make your choice
