Which he should have preferred for aught he then

event of his hazarding a new Choice, when choice had
been the Object of so much Contest, the indecorum of
his setting up his Individual Will, without necessity, in
opposition to a choice sanctioned by the 12 Judges,

his purpose: it was the Bird in hand: though,
as the Event has proved, not in his hand: it was
a fair Bird: and he knew better as he thought than to
go upon Adventures, and beat the Bush for others —

Even without looking to the tenor of the
treaty, your Lordships will find yourselves to
stand sufficiently Engaged by the Words of
the Act, when explained by the nature of the
Case. By the words of the Act your Lordships
are "required" to make choice of a spot for the
purpose, and, by the words of the Act, when
the nature of the Transaction comes to be
considered, your Memorialist has a necessary negative,
as your Lordships will find, upon any other
choice. An option is given to your Lordships
