claim to attention & deference. Your Memorialist is indeed free
to confess that were he in the situation of those gentlemen no
such appreciation would as far as he can judge have upon an
occasion like the present found their way into his breast. But he
is far, very far, and he trusts always will be from harbouring any
such unreasonable and arrogant pretension as to call upon the
gentlemen in question to take his feelings for the measure and
standard of theirs: and should the degree of sensibility they
manifest appear in the eyes even of unprejudiced persons to
go more or less beyond what might have been expected to be excited
by the circumstances of the case, he knows not of any other
sensation than that of regret which an observation to that effect
ought to excite in the breast of a candid adversary, much less in
that of an impartial judge. But there are cases, and those
unhappily but too numerous, in which the momentary feelings
of a part of the community must inevitably give way to
the lasting service of the whole: and the present case, if he is
not much mistaken, will be found one of them.

In no case where land is to be brought for public use, does
the law know any thing of neighbourhoods: it takes care, anxious
care of proprietors & occupiers: but then it stops and
does nothing at all for neighbourhoods.

Farthest of all would it be from manifesting any such
care in the use of prisons — A Prison a nuisance — then
so is a Court of Justice. A prison in a desert? no such
phenomenon was ever heard or thought of. To seat a prison
in a desert, would be to make it a Bastille. A prison to be
repelled from a country spot, on account of the populousness
of the spot? — No prison has ever been hitherto built but in
a Town. Scare a Session without an Act for such a purpose.
In any instance whatever was opposition ever made in such a
case
