essential to your Memorialist's plan and the plan
of management prescribed by the said Act, doubts
had arisen in the minds of his Majesty's Ministers
respecting the practicality or the propriety of taking
into possession of the said land under such difference,
without an express authority from Parliament: but
that Mr Pitt or Mr Dundas would as early as might
be move for leave to bring in a Bill for that purpose.

Bill brought in accordingly & passed -
That a Bill having been brought in accordingly ,
did on the 7th of July last receive the Royal Assent,
and forms the 84th Chapter of the Statute of the late
Sessions under the title of An Act for erecting a Penitentiary
House or Houses for confining & employing Convicts.
4. Powers give (inter alia)
to the Treasury by the
Act
That by Sections 1 and 3 of the said Act, powers
are given to your Lordships, in the first place, for
making choice of ground for the said purpose and
appointing a Feoffee or Feoffees by whom and in whose
name the purchase thereof should be made,
and in the next place, for contracting for the erection
of any number of Penitentiary Houses, and
afterwards for the nomination of a Governor or Governors
of such Houses when erected.

Prayer of the Memorial
1... to fix upon the old
spot.
The object of this Memorial is therefore humbly to pray
1. That your Lordships would, in execution as well
of the said Act, as in pursuance of the treaty aforesaid
