Introduced. He begs leave to add that should any other
person be made choice of for that function, the time for
taking possession of the place, perhaps the choice of
the place itself, and thence one of the most essential
points of contract, as well as your Memorialist's
capacity of fulfilling it, will thus be made dependent
upon the opinion, the good pleasure, and the leisure, of
some person as yet unknown to your Memorialist: and
that moreover, if in the execution of such power, several
persons should be joined, the execution of the said Contract
might, by a disagrement amongst such persons, experience
an indefinite retardation in addition to that of 15 years
which it has undergone already: an apprehension in
which your Memorialist is the better grounded, inasmuch
as in this very case of the Penitentiary system more
instances than one of such disagreement have
taken place, and were the original causes from which a delay
of so discouraging a magnitude took its rise.
In speaking of the place to be made purchase of as
aforesaid, your Lordships may have observed, that your
Memorialist confines the demand to the estate already
appropriated to the Penitentiary system under the
original act. The act of the last Session, under this head,
gives your Lordships an option, it is true, between the
land aforesaid and "any other as convenient & proper
"spot of ground" situated within any of certain Counties
therein referred to. Your Lordships being not the less
at liberty to fix upon the land aforesaid and thereby
adhere
