any such engagement. Could he be called upon to engage
for maintaining prisoners, on a spot where in his judgment
he could not keep them alive? on a spot, where the means
he could collect would not suffice to keep them? on a spot,
where (as was the case on board the Hulk at Langston Harbour)
every sixth man of them would die in the compass of
a year? On this ground along therefore, if there were no other,
your Memorialist, supposing a new spot to be proposed, has,
by the very nature of the predicament in which he stands, a
necessary negative upon the choice: and this negative he
begs leave to exercise once for all, upon every other spot that
has or can be thought of.

No agreement preclusive
of such a choice,
can have been made on
the part of Administration.
Your Memorialist would not be much surprized, if,
in consequence of one of those misconceptions, into which,
where the affections are engaged, we are so apt to fall, he
were to hear, tat by virtue of some conversation that may
have passed, between gentlemen expressing themselves dissatisfied
with the subsisting choice on the one part, and gentlemen
in Administration & in Parliament on the other, it should
have been conceived, that the faith of Administration stood
pledged to revoke the choice. Nor would such a supposition
altogether want colour from an incident in the history of
the Act, an incident of which it bears marks upon the
face of it. The Act originating solely out of the treaty with
your Memorialist, the purview of the Bill, as it was first
drawn, was accordingly confined on this head, as your Memorialist
admitts, to the individual spot in question. What
he has been informed of and also admitts is, that the
optional
