In the mean time, should it in any
event be your Lordships pleasure to make choice
of your Memorialist in quality of Feofee, your
Memorialist begs leave humbly to entreat as a measure
of favour to himself, and as a means of
if lopping off one future limb from that chain of unfortunate
some measure unavoidable in some measure unavoidable delays from which he has
already been so severe a sufferer, that your Lordships would
be pleased to make such appointment in the first instance,
and without waiting for the a solution of any such possible
doubts as abovementioned: in the relation to the
exsiting land: inasmuch as your Memorialists ability
of keeping himself to in a condition to enter upon
his said proposed undertaking has already been much
impaired, and is on the point of perishing, and inasmuch
as after any such appointment several steps
will would be to be taken by him under the said Act, with long
intervals between each, and inasmuch as no step
taken by any person in such quality as under any such appointment can have the
effect of precluding your Lordships from putting
a negative upon any the proceedings in relation to the
land at any period previous to that of the issuing
of the purchase-money: a step which would to the
last moment continue to exist altogether upon your
Lordships' pleasure.
