Understanding from you⊞ ⊞ on the occasion of my letter to you of the instant some time ago that you
imagined were satisfied it would appear necessary for the that Lord Commissioners of his Majestys Treasury that the had or at least would as it appeared to you
see reason to be of opinion that the powers for
for buying out the subsisting Leases should would require to be executed
by their Feoffee (to whom and to whom alone indeed those powers
are are given given by the Penitentiary Contract Act 34 G.3.c.84
§) I write this for the purpose of praying that
a letter may accordingly be written to on the part of their Lordships to that
to the Marquess of Salisbury's Agent Mr Estavent to inform
them him of letting him know that which one of the two branches
of the alternative options given by him presented in his letter to you of the
7th of March has been embraced.
A letter to this effect will be useful, of not to say necessary
in all events every event in any event –
If no provisions to the Conveyance
If on hearing Report from their Sollicitor Mr White their Lordships
should be leased think fit to waive the entering into the
previous Contract spoken of in their Should the signatures of the minute of the 2d
instant be waived, a letter to the above effect proposed might in some degree
answer the purpose of such a contract, in respect to
the communicating the requisite impression to Ms Dunn & Chapter.
2. Form of it should be their pleasure to abide by
that minute, Should ever the Contract be to be signed, an intimation to the above effect will
require to be given either to Mr White, or to Mr Estaver
or to both, for the decision of their Lordships
as between the said two officers not having been given announced in
thewritten in consequence of the above minute letter on that subject to Mr White⊞ ⊞ it would be found difficult at least to frame a Contract for the he would
find it difficult some difficulty at least to in drawing framing a Contract
until the point in question were cleared up.
It is Reference is made to their Lordships pleasure
to do either of two things – to buy the land from the leases
or to buy it subject to the leases. Both can not be done; nor
in the consequently agreed to be done therefore if they agree to do anything
they must make their option which they will do, before any
agreement can be signed by them alternative by it, before any agreement can be signed.
