4 Mr. Benthams Memorial

be made, and the said intended building erected on the proposed
part thereof, Your Memorialist is persuaded, that such repugnance
would not now exist, were it not that, so long as the proposed Contract
between Your Lordships and Your Memorialist remains as yet unsigned,
doubts are, and still will be, entertained, whether Your Lordships intentions,
in regard to the fixing of the said Establishment in the said
Neighbourhood, may not come to be revoked.

That, inasmuch as the said purchase is expressly declared,
to be only "in part", and, for other reasons, which Your Memorialist will
presently have occasion to submit, he is inclined to hope and believe,
that, in making of the said purchase, Your Lordships did not consider
the same as superseding the demand for, but rather as intended to
facilitate the purchase of, the said intended portion of Tothill Fields —
but, doubting in his own mind, (c) how far the presenting prosecuting in Parliament

a contested Bill, in the nature of an Inclosure-Bill, might be regarded
as compatible with the public service, and observing, that no steps have
been taken for the bringing in the same, since the determination, to
oppose the same if brought in, has been manifested — Your Memorialist
is apprehensive, that the said opposition not being likely to be withdrawn
so long as the said Contract remains unsigned, the obtainment of the
said intended Portion of Tothill Fields, for the erection of the said building
thereon, may not now be practicable.
