and expedient, and should cause to be inserted in such Contract
or Contracts such Lawful Clauses, Covenants, and Agreements as should
be requisite to enforce the execution of the same accordingly; and
within a Time to be limited; and might also, if such Commissioners
should think fit, appoint a proper Person or Persons to Superintend
the Erection of such House of Houses and the due performance of
such Contract or Contracts as should be entered into touching the
same with such Power as the said Commissioners should Judge

Feofee or Feofees to treat for the absolute Purchase in ffee Simple
and to accept a Conveyance of such Piece or Pieces of Ground whereon
the said Penitentiary House of Houses should be intended to be

Pieces of Ground should be fixed upon and approved of by
the said Commissioners and such Feofee or Feofees should be
appointed, the Inheritance in ffee Simple of such Piece or
Pieces of Ground should be vested in and conveyed to and to
the use of such Feoffee or Feoffees and his or their Successors for
ever, who was and were thereby made and declared to be a
Corporation Sole or aggregate (as the Case might happen) for
the special purpose of being capable to take and hold in
perpetual Succession such Piece or Pieces of Ground with all
Buildings and Erections thereon for the uses & purposes of
the said Act — And it was further Enacted that when
such Penitentiary House of Houses should be Erected in
pursuance of and according to such Contract or Contracts,
or sooner if occasion should require, it should and might
be lawful for His Majesty his Heirs and Successors from time
to time, by an Order in Writing to be notified by the
Principal Secretary of State for the Home Department,
to appoint one or more fit and discreet Person or Persons to be
Governor
