Before any details are entered into, – a few leading
facts must be stated brought to view: facts by which
every thing every matter of detail that ensues will be rendered plain and clear
facts without which every matter of detail the whole
texture of the Report can as well with as of the new the plans for which
it was designed to introduce make preparation, would from beginning to end be an inexplicable
mystery.

1. On motion by Sir Samuel Romilly moved in the
House of Commons

The contract entered into for the purpose today a with Mr Bentham
so long ago as August 1795 for the purpose being notoriously
is by Bentham an and by an Act of Parliament it has since been
declined a Contract, a Contract acted upon by both parties
and for remaining important to any good
public purpose having for the cause of such inefficiency
the unexplained and unexplicable failure on the part of
the Lord of the Treasury Board without the shadow of an
imputation upon the conduct of the thereby Appointed manager
Sir L. too for granted what no person in his place
could have done otherwise than take for granted, viz. that
to carry into effect the Penitentiary System – and to carry
into effect the Contract that had so been entered into would were
be one and the same thing.

Coming from the Opposition side and not from the Ministerial side of the House the motion
and course modified. The business in question was one of
those businesses of comparatively narrow and minor interest, to which the matter matter within
the eye of the now without doors the eye of public having been
habitually directed, the power of Administration is virtually absolute
and uncontroverted, and
whatever is done is
then in and by Parliament
a matter of form
and nothing else.
