Had the law of good faith been the law to meant to be
conformed to, observe the course that would have been taken
in execution of it.
Suppose this or that feature looked upon as a feature
of imperfection, observed in any part of the management
as settled on and by the terms of the contract what ought to
have been the course.
Here is such a thing which you are not bound to do
we think in our opinion it would be for the advantage of your own you ought to be bound to
do it or suffer. Will you consent to be bound to do it? and if
so gratuitously or in consideration of what additional allowance
in the way of indemnification?
Even suppose consent consent on any terms peremptorily
refused – important indeed would the supposed imperfection
have been to warrant the rescinding rescission of
the existing contract, taking such refusal for the ground of
it.
