When upon his own shewing and by his own confession
a man is unable to judge fairly act fairly in the character of Judge, a natural result
seems to be that in the same part in that character he should not attempt an attempt to act in that
character should not be made to act, in the other part that if made it should not
be suffered permitted to succeed.
I repeat it, it is in the character of Judge that
the worthy Baronet is called in to give judgment in
favour of his own measure, to give j pronounce judgment
and sentence on the rival one on the other side. As
Judge? exactly so: and not as party, which
in point of interest in this case he was, if ever there
was: for As Judge Being constituted Judge his opinion was in
supposing him a fit Judge it ought to be conclusive.
Had his true character proper and real, viz. that of party been the character in which he was
heard, to the other party would the opportunity would have
been given of defending himself.
