Observation to be Rotundum for the purpose of obviating
the imputation of an endeavour to reckon the same item taken over.

As to the forced sale, had either the public establishment or
the private establishment, whi so sacrificed to it as above
sacrificed to it, been suffered to go on and produce
their respective profits, the loss by the forced sale would
have been covered by it, and this item would thus
have merged in the other two.

So again as to the private establishment had the
public establishment been, according to agreement, suffered to
go on and produce its profits, the profit by the private
establishment sacrificed to it would have been merged in
it.

But, none neither of these suppositions having been realized, what
can not be dispensed with, if anything like justice be
to be done, is the suffering those three items to merits of such
the insertion of such words as may make room for the bringing
those three items into the account view.

By the general words here proposed all or any of the three
items might without discrimination be considered as comprehended,
and thereby the Treasury would, though always without being at all
bound to any thing, be at liberty to give as much as they thought advisable
on any one of them.
As to the fair real amount of the loss, is anything approaching
to it they viz. the loss by the non fulfilment of the contract it is a vast deal more than, were
they ever so desirous it would be in their power to give.
But though on this score they could not give so much as would
be justly due, and would as or so much as in so far as it could be liquidated would be
given in a question between individual and individual, it is
surely no reason why they show the injured individual should
receive nothing on this score.
