On the occasion of this clause a difficulty occurrs respecting
General Bentham. In the private establishment, such was has ever
been their confidence in each other it had never been settled
between the two Benthams what share each should have. After the private establishment
had, as above, been sacrificed to the public concern
at a time period when the public concern had for a considerable
time been at a dead stand, General Bentham was being taken
into the public service under the Admiralty, while till
several years after Mr Bentham was without any compensation
subsisting on a very reduced income, the Panopticon
concern was in a manner given up by General Bentham
as a matter not worth thinking about: inasmuch that it accordingly
is matter as General Bentham never received so nor expected
any share in the profit of the land when it came
to be put into his Brothers hands, so neither would he is is
supposed think of claiming on from his Brother in his lifetime
any share in the compensation money in question.
At the same time, considering that, of the loss and damage in question
a very considerable though never liquidated portion
for was really, as above sustained by General Bentham, and the post-obit
interest he had in the Contract is apparent upon
the face of, given, in the wording of this Amendment should not some number be made
of him in the account of loss and damage? – But if
so, given how? after the word him shall the words
and his said Brother be inserted? But then in this case
does will it not seem odd rather odd that compensation should be
provided for one alone in a case where the damage
had two to share in it?
