Supposing this proposition refused, what of better or other
expectation could he after the experience he has had
could he entertain than that the same course of his
delay and final abandonment would be pursued in
regard to the indemnification for the non performance
of the Contract as had took place in regard to the
execution of it.

For argument sake Supposing even then what according to his proposal would
now be put into his hands should upon consideration
be deemed excessive, government would always have
it in its power to compel restitution of whatsoever it
regarded as the amount of the excess.
