(b) Such being the heads of loss really incurred, and of them
either already proved or fully capable of being proved, if any
one in the description of the aggregate loss for
which compensation is to be made any one of them were
omitted, the so far from being what the Bill directs
it to be, viz. "liberal" it could not be so much as anything like just.
Of this then the loss of the by the sale of the land may
easily be ascertained.
Of the As to the two other the claims viz. loss of the
profit of the private manufacturing concern and loss of the profit
by the contract is is but too evident how far short the
greatest compensation which the Treasury could possibly think
itself warranted in giving could not but fall, of what in
probability they might have amounted to, and that these
losses should both of them be r have been rendered altogether
incapable of being estimated and thence of being adequately
compensated, is one of the great hardships in the case: but
surely on neither head can the impossibility of giving adequate compensation
be a reason for not giving any refusing to give any compensation
at all for having it altogether uncompensated.
If under the words already in the Bill viz "large sum
of money expended .... in making preparations for the performance
of the said Agreement, all those several items could and would
be excluded the no such Amendment as that here proposed would not indeed
then be necessary. But of this that such would be the
interpretation Mr Bentham sees no sufficient ground of
assurance: not so much as in relation to the private manufacturing
concern sacrificed, much less in relation to the Contract.
