Penitentiary Act Further proposed Amendments

6. Amendment 6. Page 3, line 17 After "final" insert as follows
And whereas the said Jeremy Bentham states himself to have
considered the said rents and profits as an in part compensation
for such his losses, damages and sufferings The word sufferings might be added to show losses and damages in Amendment 5. as aforesaid and
by reason of the non fulfilment of the said Contract and the possession
of the said land to have been been suffered to be retained by him and by time to time to have been retained accordingly as a pledge for the fulfilment, of the said Contract.
Be it further enacted that immediately upon on or at any time
after the day on which possession of the said land shall be taken
for the purposes of this Act it shall and may be lawful for
the said Jeremy Bentham to deliver in to the said Lords
Commissioners upon oath to be taken before one of the Barons of his Majesty's Court of Exchequer
Commissioners a full and true account of all sums received
by him received or that under the said leases might and out to have been
has been received of by him for the year ending on the Quarterday last preceding
the day of such taking possession as aforesaid reference being
in the said account made to the said leases and agreements respectively which accordingly shall by the said Jeremy Bentham shall be at the same time
respectively be delivered up and that thereupon on the then next Quarterday, if
by that time no award such award or agreement shall have been made, or upon any
such award as if made the money thereby awarded shall not
have been received paid, the said Lords Commissioners are hereby
authorized and required to pay to the said Jeremy Bentham⊞‡ ⊞‡ or to any person by him appointed – Quere can some an insertion to any such effect be necessary?
clear of all deductions whatsoever one fourth part of the sum which on the face of such account
shall appear to be the amount of such neat rent, after deduction
made of in property tax, land-tax and fee farm or quit rent as aforesaid:
and thenceforward and moreover the like sum as quarter after quarter untill the sum
due upon such award when made shall have been received.
