Such, as above, is the practice stated to the learned
Judge as carried on under his direction: such its contrariety repugnance
spirit and letter, to the Act of Parliament made for the correction

Under those circumstances, to a reader any person to whom the case has
not already been made known by the publication of Sir Richard
Philips, the result will naturally be matter of some curiosity and
some interest. His curiosity will not be disappointed.
In this the contempt thus put upon the an Act of Parliament,
in the persevering continuance of the very abuse which it was avowedly declaredly designed
to remedy, his Lordship sees not – has "never seen
"the least inconvenience". "Four and twenty years" has he borne
a part in the direction of this business, either "in the character of
"his Majesty's Chief Law Officer,⊞ ⊞ (viz. Attorney General under whose direction the Solicitor of the Crown, as abovementioned, acts) or as Chief Baron. Four
and twenty years, and in all that time says he "I have never
"seen the least inconvenience"† † p.170 – "never hitherto seen reason to
"complain."‡ ‡ p.171
Such being the premises, the conclusion in substance at
least may be without much difficulty anticipated – "It must be left to you own
discretion, whether you will risk the making us "better than
"well".
To the discretion of the person addressed, it was not the attempt indeed was, but unfortunately the success of that attempt was not however
