But the Master – the Officer so high in authority under
the learned Judges is it seriously to be apprehended imputed
it is by him that on each occasion the selected qualified
list is formed – and of him can any suspicion be
seriously entertained that in making the selection he
should suffer his choice to be turned aside from the path
of impartial justice?
My answer is – that considering all along the
genus – and, unless forced upon me by particular occurrences without a thought about individuals– it
is by in that very situation of his that my suspicion – the
existence of which I can not but I have confessed already, has its cause. Bound
to his superior by the closest ties of a common interest
those all his sympathies are on their side: and were it
otherwise, it depends on the part of his learned revered superiors
nothing but the will would be requisite, to render his situation
under them as uncomfortable as it need be. In
In each Court, by a system of mechanisms which has
never been known to be out of order, the life and power of the
Master (not to speak of all others in the same ) find
their premium be in the bosom of the Chief Judge.
Thus much for generals – but for particulars of
probability may it not be tolerably well proved by fact?
to put if not merely only the questionable rules of unwritten justice
but the spirt and acknowledged spirit as well as letter of positive written and positive law should have
on the part of this one of those very minister of justice have found

them, with open eyes, and in the bulk despite of remonstrance?
