Page 158 (f) – (the enclosed letter) Here then is a statement,
of the contents of which the Lord Chief Baron is fixt
with notice: and of which in his answer, p. 169.) as will be seen
presently, he accordingly does take notice.
In this enclosed letter dated 10 March 1808, the learned adviser (it is that
the of the Sheriffs two learned advisers it is that one of them that
dates from the Temple) begins with saying "I agree with you
"in thinking that the clause referred to in the enclosed act of
parliament applies to special as well as common jurymen:
for if it be inconvenient for the latter" (the common Jurymen) "to attend oftener than
the act requires, it must be much so to the former",
(viz. Special Jurymen) "on account of their rank and situation
"in life". The clause in question is evidently
the 4th Section in the Act 3 G.2.c.25. to which for the so far
purpose of enforcement as concerns Middlesex⊞
⊞ in the declared view
of diminishing the
quantity of vexation
considered ad producible
by the too frequent
recurrence of this service an amendment is the shape made
in the next year by the Act 4 G.2.c.7.
This Notwithstanding, or else perhaps in virtue of, his
learning this learned gentleman (it may be of use to observe)
either is not or affects not to be, in the secret. He is not
apprized, even of that point of practice of which one should
have thought scarce of expected to find any learned or unlearned person in London
of Middlesex⊞ ⊞ of a virtue such
on the scale in point of education
and knowledge of the
world unapprized: viz. that Special Jurymen receive
in each cause at least a guinea apiece the maximum allowed by the Act.; or else it does not enter
into his conception, that on the part of a gentleman stiled
an Esquire who is or is supposed to be a person who has
nothing to do in respect of business is at this case there
should be anything in the nature of guineas capable of
operating as compensation for such as it is in the nature a days attendance
in good company, in a judicial situation to
make in a man's case.
