Hence necessary if spaces
But in order that the press may operate as a security
for good government it is necessary the it should be
from not only one law as against the constituted authority but in fact and as against
every in whose power and inclination it might
be to it otherwise.
To secure to every public man upon whose reputation
in respect of fitness an attack is made through the medium
of the press, full and adequate means of defending himself
through the same medium, is not within the power of the
law: since the faculty of obtaining for this or any
purpose the use of this or that press depending unavoidably upon
the will and pleasure of the owner of it.
By the power of law all that can be done towards so
desirable an end is, in case of any attack made upon
the reputation of any person by false and injurious aspersions,
the securing to him the faculty of rendering calling to
account the author of the aspersion in the face of justice responsible for it according to the decision of the Judge,
and at the same time the faculty of giving to his
determination so to do a degree of publicity equal to at least
to that which has been given to the aspersion itself:
that so the fact at least of the existence of a defence may be as no less public than
in the fact of the existence of attack, and every person who is desirous
of passing forming an impartial judgment may have
notice to suspend the formation of it till the means of rendering
it impartial well grounded are within his reach have come to light.
Such This accordingly is the design which has given birth to the
following portion of law
distinguished by the appellation
