On this occasion, as on every other, whoever has
a mischief to cope with the fuller more correct and compleat the
view he has of it the better.
Be the person who they may, the people themselves,
or public functionaries of any description, exercising
to the effect in question the power of the people,
the efficient causes of misguidance error by which the
exercise misconduct error of power in question will be produced may
be referred either to the head of false facts or fallacious
arguments: fallacious arguments, consisting
of fallacious observations grounded on fal such and such facts whether
false or true.
In case of false facts the falsity is not in its
nature incapable of being encountered by punishment,
therefore in this case and this far to this extent misrepresentation
is not incapable of being encountered, and as far as
depends upon punishment prevented, by the power of the
law. To this then should the endeavours of the legislator
be directed. In the
