Tothill Fields Act §§.2
declared his or their refusal of such acceptance then and
in either such case the said Feoffee or Feoffees shall
cause the value of such the said portion of
Land marked A to be ascertained by a Jury
in manner as is directed by by the said Act of
the seventh day of July 1794: and thereupon
of the said sum of money found by such Jury
to be the value of the said portion of Land be
not greater than the sum so paid into the Bank
of England as aforesaid then immediately upon the
giving of such Verdict it shall and may be lawful to and
for such Feoffee or Feoffees his or their Workmen
or Agents to make such entry as aforesaid or if
the said sum so found should be greater than the
sum already paid into the said Bank of England
as aforesaid then upon payment made into the said Bank of the difference
between such lesser and such greater
sum and such sum already paid it shall and may be
lawful to and for such Feoffee or Feoffees his or
their Workmen or Agents as aforesaid to make
such entry as aforesaid and as well the said
Dean and Chapter as [+] [+] or the Rector of
the said Parish of
St John's and all persons exercising or
intitled to exercise any right or rights of common
in or upon the or in relation to the said
portion of the said Waste shall be divested of all
right and title possession and claim of in or to the
said Land so entered upon and every part thereof
(saving such rights as are herein after specially reserved)
with as full effect as if possession thereof had been delivered
to such Feoffee or Feoffees in due course of law.
