settling differences

And whereas the said Lots A and B portion intended to
be purchased for the purposes of this Act as also
the said portion B intended to be allotted to the said Dean & CHapter for the
use of the said Scholars are both situated
within the said Parish or Rectory of St Johns
and whereas the said Parish being or a Rectory
the Rector thereof would on a division of whereby on a division of WasteCommon Land
subject to rights of common within such
part of the said Waste as is situate within
the said Parish the Rector thereof would be
entitled either to a share thereof in kind or to a compensation
for the same. And whereas
doubts or differences have arisen subsist between the said Dean &
Chapter on the one hand, and the said United
Parishes on the other touching the nature
and extent of their respective rightsinterests in and
conceive of the said Waste And whereas by
reason of the variety, obscurity, voluminousness
or antiquity of the evidence which might
require to be produced and investigated, produced
and commented upon, the said doubts without such a
or differences might be capable of being decided upon
and terminated in the ordinary course of justice under without
undera period of such a length, that the waiting for the expiration of time as might be
thereof might be altogether incompatible with the purposes of this Act
