Compelling evidence
§. 20
Commissioners
may summon
and examine
Witnesses
And be it further enacted, that it shall and may be
lawful to and for the said Commissioners or Arbitrators
from time to time, by writing under their hands
to summon any person or persons to appear at
their said place of meeting at a within at a day
and within a time to be therein specified,[+] then
[+] bringing withhim or them
at the same time
any such written
or real evidence
as he or they shall therein
be required to bring
with them him or
them
and there to be examined upon Oath or in the
case of a Quaker upon solemn affirmation
touching any of the matters and things hereby
submitted to their the cognizance of the said Commissioners
or Arbitrators, and to cause a Copy of
such summons to be served summoned upon every
such person, or left at his or her place of
abode: and every such person who, having
been so summoned shall not appear to in
pursuance of such summons, or appearing
shall refuse to be sworn or make affirmation,
as the case may be, or to be examined (the
reasonable charges (if any) of his or or her attendance
being first settled by the said Commissioners
or Arbitrators and first paid to or tendered
to him or her) may be on application made
to the High Court of Chancery be proceeded
upon against in like manner as if such summons
had issued from the said Court: and every
person giving fabri being guilty committing perjury on
any such examination shall suffer and
may be prosecuted for the same in the same
manner as if such perjury had been committed
on any examination taken under the d according to the practice of the said Court.
