And for as much as it might be prejudicial
to the security and good order of the said
intended Penitentiary House or Penitentiary
Houses, if access thereto or to the near vicinity
thereof were open without restriction to all
persons at all times Be it enacted that
in as far as land in the state of Waste
and Common Land is concerned, all general
right of way exercisable by his Majesty's
subjects indiscriminately over the same such part thereof as shall have been purchased for the purpose of this and the said former Act shall immediately
upon such entry as aforesaid cease and be
extinct: the said Feoffee or Feoffees taking care
either to leave or out of such Waste or to
assign and set out from and one of such other land, if any
as shall be purchased for the purposes of this Act
a line of space sufficient and convenient for the exercise
of that right of way, notice of such intention and change being fixed up in conspicuous characters in some conspicuous part of the premises as also to make, if
necessary, and at any rate, to keep in good and perpetual repair (which they are hereby required to do) a good and convenient road
over over and along the same, which Road, in as far as such
right of way extended to carriages, shall not
be of up breadth than thirty feet: and if,
